Edna Bailey Price, Arthur H. Price, Patty Bailey Collins and
Linda Bailey Collins, Plaintiffs v. Robert B. Harvey, Barbara R.
Harvey, and Unknown Heirs of L.F. Porterfield, G.T. Porterfield,
and W.A. French, Defendants. Case No.: CL09-000009. Amended
Complaint – To the Honorable Judge of said Court: Your
Plaintiffs, Edna Bailey Price, Arthur H. Price, Patty Bailey
Collins, respectfully represent as follows: 1. That they are co-partitioners
of a certain tract or parcel of land in the Eastern Magisterial
District of Giles County, virginia, containing 6.168 acres, more
or less, being a tract conveyed to your Plaintiffs by deed from
Willard R. Meadows. This deed is attached hereto as Exhibit A.
2. That Willard R. Meadows conveyed to your Plaintiffs all of
the interests he received in this realty from Alice Porterfield
Thorn and Gerald E. Porterfield, the children of Clinton
Porterfield. ClintonPorterfield, the son of Lewis F.
Porterfield, acquired title to 175 acres of realty in a
Commissioner’s sale by deed dated August 12, 1890. This deed is
found in Deed Book R, page 152 in the Clerk’s Office of the
Circuit Court of Giles County. This deed is attached hereto as
Exhibit B. A survey of the 175 acre property is attached hereto
as Exhibit C. 3. That the original sale of the 175 acres was
made to three buyers/grantees, namely Lewis F. Porterfield, G.T.
Porterfield, and W.A. French. 4. That the 6.168 acre tract is a
part of the original 175 acre parcel of land. 5. That this land
appears in a plat surveyed by John B. Abbott, P.E., C.L.S.,
identified on the plat as Parcel A is a triangular piece of
realty containing 6.186 acres with metes and bounds N 88 deg 36’
09" W 1008.13 feet to a corner; thence s 66 deg 01’ 01" W 487.24
feet toa point; thrence N 66 deg 01’ 01" E 623.99 feet to a
point; thence s01 deg 00’ 00" W 511.50 feet to the beginning.
This plat is attached hereto as Exhibit D. 6. That this 6.186
acre parcel of land has no tax number listed in the Office of
the Commissioner of revenue of Giles County and no taxes are
being collected on it. 7. That this land had been part of the
Porterfield estate but as that realty was divided and
subdivided, this particular parcel had not been conveyed to a
new owner. 8. That the Plaintiffs believe that a deed Dated
December 7, 2000, which is on file in the Circuit Court Clerk’s
Office of Giles County, Virginia in Deed Book 322, page 256,
wherein Robert B. Harvey and Barbara t. Harvey made a deed of
gift to themselves for this realty is without merit and simply
an attempt to obtain a tract of land they believed to be
unclaimed. A copy of this deed is attached hereto as Exhibit E.
9. That the Plaintiffs respectfully allege that uncertainty over
ownership of the realty makes it in the best interest of all
parties for the Court to determine ownership of this tract of
realty. Wherefore, the Plaintiffs pray that the Court will issue
an order (1) adjudicating the respective interests of the
parties of this cause; (2) directing a distribution of the
realty to the owners in relation to their respective interest;
and (3) granting such further and general relief as the Court
may find warranted. Respectfully submitted, Edna Bailey Price,
Arthur h. Price, patty Bailey Collins & Linda Bailey Collins.
